RFQs, Offers & Contract Formation

Submitting an RFQ does not create any contractual obligation.

All quotations, price indications, lead times, availability information, and delivery estimates are non-binding until confirmed in writing through an Order Confirmation or Proforma Invoice.

Availability and lead times may change due to supplier stock levels, logistics constraints, regulatory requirements, or market conditions beyond AWEMARINE’s control.

 

No Consulting or Dimensioning by Default

As a general rule, AWEMARINE does not provide engineering consulting, technical calculations, application validation, or component dimensioning, unless such services are expressly agreed in writing as a separate engagement.

Any offer or order is based exclusively on the part identification and selection confirmed by the customer, using part numbers, descriptions, drawings, photos, or other information provided by the customer.

The customer is solely responsible for verifying that the selected parts are suitable for the intended application, operating conditions, and use.

 

Application Suitability & Installation Responsibility

Unless explicitly agreed otherwise in writing, AWEMARINE excludes any warranty or guarantee that supplied goods:

  • are suitable for a specific application or operating condition,
  • can transfer maximum torque or load in a specific drivetrain,
  • are suitable with respect to torsional vibration, resonance, or dynamic behavior,
  • can be installed without additional verification or modification.

Installation, commissioning, operation, and maintenance of supplied parts are the sole responsibility of the customer or their appointed service providers.

AWEMARINE recommends that commissioning of drivetrains and rotating equipment be performed gradually and in a controlled manner in order to identify potential resonance ranges or abnormal operating behavior.
Any assistance during commissioning is subject to a separate written agreement.

 

Customer-Provided Technical Data

Where technical verification or evaluation is agreed separately, the customer is obligated to provide complete, accurate, and correct technical data required for such assessment.

AWEMARINE does not independently verify customer-provided data.
If incorrect, incomplete, or misleading information is supplied, AWEMARINE excludes any warranty or liability regarding suitability, performance, or application compatibility.

 

Documentation & Classification

OEM documentation may be provided when available from suppliers.

AWEMARINE does not issue vessel-specific or classification society certificates unless explicitly agreed in writing.
All class approvals, surveys, inspections, and compliance requirements remain the responsibility of the vessel owner, operator, or appointed service company.

If inspection or acceptance by a classification society is required, the customer is responsible for providing all necessary vessel, equipment, and serial number information in advance.
Costs and lead times depend on the classification society and are outside AWEMARINE’s control.

 

Limitation of Liability

To the maximum extent permitted by applicable law, AWEMARINE shall not be liable for:

  • indirect or consequential damages,
  • loss of profit, revenue, or business,
  • vessel downtime or off-hire,
  • delays caused by third parties,
  • installation errors or improper use,
  • reliance on incomplete or incorrect customer-provided information.

Any liability, if applicable, shall be limited to the value of the goods supplied under the relevant confirmed order.
